Important Notice for Users from the European Union (EU) and the United Kingdom (UK) about Cross-Border Transfer and Storage of Personal Data in India

We value your trust and are committed to providing maximum transparency regarding the processing of your Personal Data. As you are a resident of the European Union or the United Kingdom, your personal data falls under the scope of the EU General Data Protection Regulation (GDPR) or the UK GDPR, which establish strict requirements for privacy protection.

We would like to inform you that the personal data you provide through Film in Moscow Services will be transferred to and stored on servers located in India.

The European Commission and the UK government have not currently adopted an adequacy decision in respect of India. This means that, in their view, India's data protection legislation does not provide an "essentially equivalent" level of personal data protection compared to the EU GDPR or UK GDPR.

Legal Basis for Data Transfer

In the absence of an adequacy decision, the transfer of your Personal Data to India will be carried out based on your explicit consent. This means you must actively and unambiguously agree to such a transfer after receiving full information about the associated risks.

Potential Risks Associated with Data Transfer to India:

Since India does not have an adequacy decision from the EU or the UK, there are certain risks to the protection of your Personal Data that may differ from those existing in your country:

Lack of Equivalent Level of Protection: Despite India having the Digital Personal Data Protection Act (DPDPA) 2023, which contains principles similar to GDPR , it may not provide the same level of protection or the same specific rights as the EU GDPR/UK GDPR.

Potential Government Access: Indian law may allow broader access by public authorities (e.g., law enforcement, national security agencies) to your data than is permitted in the EU or UK, and this may occur without equivalent judicial oversight or effective legal remedies for you.

Limited Legal Remedies: In the event of a breach of your data protection rights or misuse of your data, it may be more challenging for you to exercise your data subject rights or obtain effective legal remedies in India compared to the EU or UK.

Differences in Legal Basis: While India's DPDPA requires explicit consent, its "certain legitimate uses" for data processing without consent are narrower than "legitimate interests" or "contractual necessity" in GDPR. This could lead to differences in how your data is processed.

Our Safeguards and Your Rights:

Despite the above risks, we commit to taking all reasonable measures to protect your data. We will:

• [Implement Standard Contractual Clauses (SCCs) approved by the European Commission, or the International Data Transfer Agreement (IDTA) / International Data Transfer Addendum (Addendum) approved by the UK Information Commissioner's Office (ICO), with our service providers in India. These contractual provisions are designed to ensure your data receives a level of protection comparable to European standards.

• Apply robust technical and organizational security measures, including encryption, access controls, and regular audits, to protect your data both in transit and at rest.

• Conduct Transfer Risk Assessments (TRAs) to identify and mitigate potential risks]. Your data subject rights under the EU GDPR and UK GDPR (including the right to access, rectification, erasure, restriction of processing, objection to processing, and withdrawal of consent) remain in effect.

We will provide you with mechanisms to exercise these rights, regardless of where your data is stored.

You have the right to withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. To withdraw your consent, please contact us at. Please note that withdrawing your consent may affect your ability to use certain features or services of Film in Moscow Services.
